Terms of Participation
In short: we play for fun and for movement. Participation is voluntary, only real workouts count, we look after ourselves on the road — and we look after your data. The detailed scoring rules are set by the administrator in the app, where they are always up to date.
§ 1. Organiser and nature of the challenge
- The organiser of the company sports challenge run in the Activly application (the "App") is Notinote Sp. z o.o., ul. 3 Maja 49C/6, 61-728 Poznań, Polska (the "Organiser").
- The challenge is internal, recreational and team-building in nature. It is not a sports competition within the meaning of sports regulations, nor a game of chance.
- Participation is voluntary, is not an employment duty and has no effect on performance evaluation, remuneration or any other terms of employment or cooperation.
§ 2. Participants and accounts
- Any employee or contractor of the Organiser may take part by creating a personal account in the App (themselves or via the campaign administrator) and joining a campaign.
- One person — one account. The account is personal; do not share your password.
- The campaign administrator is a person designated by the Organiser. They set the game parameters and may add participants, fill in declarations at their request and remove incorrect entries.
§ 3. Campaigns and rules of the game
- The challenge runs in campaigns — cycles with a start and end date. At most one campaign is active at a time. Only activities within the campaign period count.
- Disciplines: running, cycling, inline skating. The base unit is distance in kilometres.
- For each campaign the administrator selects one mode:
- team mode — participants submit secret kilometre declarations, are drawn into balanced teams, and kilometres are converted into points using discipline multipliers, a position-in-team multiplier and a bonus for fulfilling the declaration; teams compete for the podium and the whole company for a shared kilometre goal;
- individual mode — no board, ranking or totals; everyone sees only their own kilometres, records, commutes and badges.
- The current parameters (dates, multipliers, team size, goal, offices) are shown on the home page and in the App. Changing parameters during a campaign is allowed only to fix an obvious error and is announced to participants.
- A group training (badges "Better together" and "Peloton") is credited solely on the basis of GPS tracks from files uploaded by participants, when at least three members of one team were on the route together. A commute is credited when a workout starts near the participant's home and ends near an Organiser office (or the reverse). Uploading a track and setting a home are voluntary.
§ 4. Fair play
- You submit only your own, actually completed workouts, with the true distance and date.
- Submitting someone else's workouts, motorised trips, artificially extended or duplicated entries is prohibited.
- The administrator may remove an entry that raises reasonable doubt and, in case of repeated violations, exclude a participant from the campaign. Before exclusion the participant has the right to explain.
- Scoring disputes are settled by the campaign administrator, whose decision in matters of the game is final.
§ 5. Prizes
- Whether a campaign has prizes, which and for what (e.g. the shared company goal, the team podium, badges) is decided by the Organiser and announced to participants before or during the campaign.
- Prizes are symbolic and team-building in nature. They cannot be exchanged for a cash equivalent unless the Organiser decides otherwise.
§ 6. Safety and health
- You train at your own risk and according to your own assessment of your abilities. If in doubt about your health, consult a doctor before starting.
- Observe traffic regulations and safety rules; on a bike or skates we recommend a helmet.
- The Organiser is not liable for injuries, damage or incidents occurring during workouts performed as part of the challenge, except where liability follows from mandatory provisions of law.
§ 7. Strava and other data sources
- You can add workouts manually, from a GPX/CSV file or — after connecting your account — from Strava. All sources count equally.
- Connecting Strava is optional and requires your explicit consent given in the App. You can withdraw it at any time. Use of Strava is additionally subject to Strava's Terms of Service and Privacy Policy.
- The App is not a Strava product and is not endorsed by Strava. "Powered by Strava" means only that we use Strava's official API.
§ 8. Personal data
How we process data — including who sees what, how long we keep data and how to delete it — is described in the Privacy Policy, which forms part of these Terms.
§ 9. Ending participation
- You may withdraw at any time — simply stop adding workouts or ask the administrator to delete your account.
- Termination of employment or cooperation with the Organiser ends participation; the account is deleted.
§ 10. Final provisions
- The Organiser may amend these Terms for important reasons (change of law, material change of the game mechanics). Changes are announced in the App and do not apply retroactively to a running campaign, except to fix obvious errors.
- Polish law applies to matters not covered here.
